1. Acceptance of Terms

Welcome to NearMatch. By accessing or using our website, web application, and anonymous peer communication services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. Eligibility & Age Restriction (18+ Requirement)

You must be at least eighteen (18) years of age to register an account or use NearMatch. By using the Service, you represent and warrant that you are of legal age and possess the legal capacity to enter into this agreement under applicable Philippine law.

3. Anonymous Access & Passcode Security

NearMatch provides pseudonymous peer discovery without collecting your real name, email, or telephone number. When registering, you select an anonymous handle and a 6-digit numeric passcode. You are solely responsible for maintaining the confidentiality of your passcode. NearMatch cannot recover forgotten passcodes due to our irreversible cryptographic salted storage.

4. User Conduct & Safe Spaces Act (RA 11313) Compliance

NearMatch enforces strict compliance with Republic Act No. 11313 (The Safe Spaces Act) and Republic Act No. 10175 (Cybercrime Prevention Act of 2012). Users agree not to engage in:

Gender-based online sexual harassment, cyberstalking, or non-consensual sharing of explicit or intimate media.
Hate speech, bullying, extortion, threats of bodily harm, or harassment targeted at any individual or community member.
Impersonation of community moderators, platform staff, or other members.
Automated scraping, bot spamming, or attempting to compromise platform infrastructure.

Violations will result in immediate and permanent hardware/IP bans and may be reported to law enforcement authorities where required by Philippine law.

5. Mutual Photo & Avatar Reveal Consent

All avatar profiles and media default to an obfuscated or blurred state. A profile is only unblurred when both participants mutually click the "Reveal Profile" button. You agree to respect the privacy of other members and not distribute or screenshot conversations without consent.

6. Disclaimer of Warranties & Limitation of Liability

NearMatch is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for high uptime and active moderation, we do not guarantee continuous uninterrupted service or endorse the views expressed by individual users during peer sessions.
